The petitioners seek bail in anticipation of their arrest in connection with Neemchak (Bathani) P.S. Case No. 82 of 2020 dated 08.05.2020 instituted for the offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
The accusation against the petitioners is of having assaulted the mother and brother of the informant.
Learned counsel for the petitioners has
Patna High Court CR. MISC. No.2877 of 2021(2) dt.27-07-2021 2/2 submitted that they are the first cousins of the informant and because of land dispute between the families, this case has been lodged.
There is a counter version of the occurrence also.
There is no injury report on record.
It has been submitted that because of such dispute between the two families, this false case has been lodged with general and omnibus allegation. Regard being had the aforestated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-X, Gaya in connection with Neemchak (Bathani) P.S. Case No. 82 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
