JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 25.03.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 324, 341, 427, 379, 504 and 406 of the Indian Penal Code, Section 27 of the Arms Act, Section 3/4 of the Explosive Substances Act and Section 17 of the Criminal Law Amendment Act.

It is alleged that 26 accused persons came variously armed, robbed the articles of the informant and hurled explosive as a result of which part of the building got demolished. It is submitted by learned counsel for the petitioners that the petitioners were not named in the FIR, their name subsequently, sprang up on the confession of co-accused when nothing has been

Patna High Court Cr.Misc. No.1678 of 2015 (2) dt.16-01-2015 2/2 recovered from the possession of the petitioners nor the petitioners were put on T.I. parade and other accused has been granted bail by this Court vide Cr. Misc. No. 40990 of 2014. Though, the petitioner is accused in 8 other cases but in all the case the petitioners have been roped during investigation. Considering the aforesaid facts, let the above named petitioners be released on bail, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, West Muzaffarpur in connection with Paroo P.S. Case No. 153 of 2013.
