2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. 3.6 liters of foreign liquor has been recovered from scooty.

4. It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the scooty and has got no concern with the seized liquor. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.50121 of 2023(2) dt.11-08-2023 2/2 from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act Patna in connection with Budha Colony P.S. Case No. 327 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
