2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 354, 376, 120(B), 504, 506 and 34 of the Indian Penal Code . 3 . As per prosecution case , this petitioner along with other co-accused persons are alleged to have abused and assaulted informant, when she revealed that co-accused Prashant Kumar Ranjan committed rape with her on several occasions on the pretext of marriage .
4. Learned counsel for the petitioner submits that this petitioner has falsely been implicated in this case merely because he happens to be father of co-accused Prashant Kumar Ranjan . Specific allegation of commission of rape is against
Patna High Court CR. MISC. No.50183 of 2024(5) dt.03-01-2025 2/2 co-accused Prashant Kumar Ranjan . No specific accusation is alleged against this petitioner. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class Munger in connection with Bariyarpur P.S. case no. 94 of 2024 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
