====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-12-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Govindganj P.S. Case No. 649 of 2023 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.
3. Allegation against the petitioners is that the petitioners along with one co-accused Arjun Das kidnapped the minor daughter of the informant.
4. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have committed no
Patna High Court CR. MISC. No.53488 of 2024(4) dt.05-12-2024 2/2 offence. They have been falsely implicated in this case due to village politics. The allegation levelled against the petitioners is totally false and based on concocted facts. Only on suspicion all the petitioners are named in the instant case. It is further submitted that petitioners have no criminal antecedents as mentioned in para-3 of this application.
5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that the victim is still traceless.
6. Considering the facts and circumstances of the case as well as submissions made by the learned A.P.P, I am not inclined to enlarge the petitioners on anticipatory bail. The prayer for anticipatory bail of the petitioners is hereby rejected.
