2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, registered in connection with Dumrao P.S. Case No. 173 of 2024.

3. As per prosecution case, there has been recovery of total 82.80 liters of foreign liquor from an E-Rikhsaw in which petitioner was sat.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the alleged recovery of liquor. He further submitted that the

Being the passenger of the seized vehicle, he has been falsely made an accused. Petitioner is a person of clean antecedent and he is in custody since 14.05.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case and the petitioner having clean antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. 1, Buxar in connection with Dumraon P.S. Case No. 173 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
