JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-01-2020 It appears that while granting bail to the petitioner on 20.09.2019, this Court has not noticed the specific statement made in para 10 of the petition that the petitioner was remanded in the present case from Saraiya P.S. Case No. 130 of 2019. In fact, the case of petitioner has been considered for grant of bail on the backdrop of the fact that "the petitioner was not named in the F.I.R. and his name surfaced in the confessional statement of co-accused."

The aforesaid observation be read in the order dated 20.09.2019 in place of "Considering the fact that the petitioner has no criminal antecedent".

The order dated 20.09.2019 is modified to the extent mentioned above.
