This application for anticipatory bail arises out of Ismailpur P.S. Case No. 64 of 2020 for the offence punishable under Sections 30(A) & 38(i) of the Bihar Prohibition and Excise Act, 2018.

From the reading of the F.I.R., it appears that Police got an information that one Sanjay Mandal was involved in selling liquor and on such information, they raided the house of said Sanjay Mandal and he was arrested. Thereafter, on the basis of his confessional statement, the name of the petitioner, who is own brother of Sanjay Mandal, has come in the F.I.R. However, from reading of the entire F.I.R., it transpires that it is Sanjay Mandal, who was involved in the illegal activities. Considering the aforesaid facts, this application is

Patna High Court CR. MISC. No.2014 of 2021(2) dt.03-11-2021 2/2 allowed. Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge -cum- Special Judge, Excise, Bhagalpur, in connection with Ismailpur P.S. Case No. 64 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
