The petitioner Shatrughan Yadav seeks bail in Motihari Muffasil P.S. Case No. 104 of 2013, registered for the offences punishable under Section 395 of the Indian Penal Code. The informant alleged that many persons came on his patrol pump on a Bolero Jeep and thereafter they committed dacoity.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the confessional statement of co-accused but the petitioner was not put on test identification parade. Learned APP did not dispute the facts.

Patna High Court Cr.Misc. No.51925 of 2014 (2) dt.05-01-2015 There appears that the name of the petitioner figured in the case in the confessional statement of co-accused and he was not put on test identification parade although he is in jail since 30.05.2013.

Considering the facts aforesaid and nature of allegation made against the petitioner, he above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in connection with Motihari (M) P.S.
