The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, it is stated by the informant that the daughter of the informant happens to be the second wife of Vivek Sah while the petitioner happens to be his first wife. As a result of differences among the family members, all the accused persons including the petitioner herein assaulted the daughter of the informant resulting in her death. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations in the FIR are general and omnibus in nature. Having heard learned counsel for the parties and taking into consideration the nature of allegations in the FIR being general and omnibus together with the petitioner having remained in custody for 9 months since 6.4.2022 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Murliganj P.S. Case no. 177 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Madhepura.
