BAJANTHRI) 02-05-2023 In the instant writ petition, petitioner has prayed for the following relief(s):- "(i) For direction for cancellation of Tender Notice dated 29.12.2015 published in daily Hindi News Paper "Dainik Bhaskar"

inviting tender for the work of outsourcing in different district Hospitals of the Bhojpur as in earlier advertised Tender on 25.07.2014 for the same work petitioner alongwith many others participated and after qualifying in Technical and Financial Bid finally work order has been

Patna High Court CWJC No.1286 of 2016(4) dt.02-05-2023 2/2 allotted to him but without even noticing him or cancelling his work order this another Tender Notice has been issued for the same work which is arbitrary and in violation of principle of natural justice and require to be cancelled. (ii) For direction upon the respondent District Health Society, Bhojpur cancel/withdraw to this Tender Notice dated 29.12.2015 as in its terms & condition. Some clause has been put with an intension to declare the respondent No. 5 successful as this N.G.O. only fulfils this condition.

(iii) For direction upon the District Health Society, Bhojpur to not proceed in the process of this fresh Tender until petitioner is being given chance to establish his case that his work order is valid one and no necessity of issuance fresh Tender arises.

(iv) For any other relief for which petitioner be found entitled to in the facts of the case."

02. There is no interim order. Therefore, we have to presume that tender notice dated 29.12.2015 is stated to have been given effect and attained finality.

03. Accordingly, the present writ petition stands dismissed as it has become infructuous.
