JUSTICE SHIVAJI PANDEY ORAL ORDER 10-10-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Learned counsel for the petitioners is permitted to make necessary correction in paragraph 1 of the bail petition. The petitioners apprehend their arrest in Kargahar P.S. Case No. 129/2017 for the offences punishable under Sections 147,

Patna High Court Cr.Misc. No.45837 of 2017 (2) dt.10-10-2017 2/2 148, 149, 341, 323, 307 of the Indian Penal Code. As per the allegation, the accused persons with the help of pump were trying to dry the pond, which was objected by the informant stating that the water is being used by the animals of the locality, whereupon all the accused persons started abusing and threatened to kill him. When the informant raised hulla, all villagers came there and then the petitioners resorted to air firing towards villagers.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. Petitioner no. 1 is bonafide Bandobasti holder of the pond for fishing the same. Considering the facts aforesaid, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Kargahar P.S. Case No. 129/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J.) Rakhi U T
