The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 341, 323, 354 and 354A(I)(IV)/34 of the Indian Penal Code.

The victim is student of Aryabhat Computer College in which the petitioner is said to be the teacher. Allegation has been made that accused persons kept oblique view on the victim. On the fateful day while she was coming out from the College, they were teasing her and when she tried to flee then they forcibly tried to caught her. Thererafter she protested but she received slaps upon the cheek. She became unconscious. Later on she has narrated the story to her sister.

Patna High Court Cr.Misc. No.40608 of 2017 (2) dt.19-09-2017 On the similar allegation one Ajay Kumar has been granted anticipatory bail by this Court vide Cr. Misc. No.38841 of 2017.

Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Ganesh Dutt Mishra, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxer in connection with Dumraun P.S. Case No.80 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that as and when petitioner is required, he will present himself for the purposes of investigation.
