JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 18.11.2003 in a case registered for the offences punishable under Sections 147,149,341,364 and 379 of the Indian Penal Code. It is alleged that Kari Sahani was abducted by the accused persons and subsequently he was killed. It appears that the case was instituted in 1996. the petitioner is in custody since 2003. Statement has been made in paragraph 16 of the petition that petitioner has never been produced in court after commitment though the petitioner is accused in three other cases.
Considering the period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.120 of 2015 (2) dt.07-01-2015 2/2 satisfaction of learned Additional Sessions Judge - V, Barh, Patna in connection with S.T. No. 114 of 2004 arising out of Bakhtiyarpur P.S. Case No.47 of 1996.
The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on two consecutive occasions. Let the learned Additional Sessions Judge - V, Barh, Patna transmit a report as under what circumstances the trial has not proceeded after fixing responsibility of the person concerned due to whose laches the trial has not proceeded.
