Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, 3200 liter of illicit foreign liquor has been recovered from a truck and a Santro car. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is neither driver nor owner of the vehicles in question. Petitioner is in

Patna High Court CR. MISC. No.56823 of 2021(3) dt.31-01-2022 2/2 custody since 05.07.2021. Investigation is complete. Learned counsel appearing for the State opposes the prayer for bail. He submits that the petitioner has got identical criminal antecedent.

Considering the rival submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court concerned in Obra Police Station Case No. 101/2021, once the charge is framed in the case.
