====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Kasim Bazar P. S. Case No. 201/2024 in a case registered for the offences punishable under Sections 103(1), 92, 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, this petitioner assaulted the informant and his wife fists and slaps, as a result of which she died during course of treatment.
4. Learned counsel for the petitioner submits that informant is own brother of the petitioner and due to family dispute, this false and concocted case has been lodged. During trial, altogether four witnesses have been examined, including the informant, and none of them have supported the prosecution
Patna High Court CR. MISC. No.51050 of 2025(3) dt.31-10-2025 2/2 case. As a matter of fact, deceased fell from the staircase due to which she sustained injury and died. Petitioner is in custody since 31.07.2024.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kasim Bazar P. S. Case No. 201 of 2024.
