2. The present application has been filed seeking cancellation of the regular bail granted to Opposite Party no. 2 vide order dated 09.04.2026 passed in B.P. No. 163/ 2026 arising out of Mirganj P.S. Case No. 141 of 2021, registered under Sections 341, 323, 324, 307, 498(A), 406, 325, 504/34 of the I.P.C. and Sections 3/ 4 of the Dowry Prohibition Act.

3. Learned counsel for the petitioner submits that the opposite party no. 2 has violated the conditions of bail by failing to comply with the direction of the learned court below to pay a sum of Rs. 2,000/- per month to the petitioner till the disposal of

Patna High Court CR. MISC. No.52290 of 2026(2) dt.28-07-2026 2/2 the case, in the event that O.P. No. 2 does not keep the petitioner with full dignity.

4. Accordingly, the present application stands disposed of with liberty to the petitioner to approach the court below, by filing an appropriate application on the aforesaid ground.

5. If such an application is filed, the same shall be considered and decided by the learned Magistrate concerned, in accordance with law, within a period of 15 days from the date of its filing, after affording an opportunity of hearing to all concerned parties. In the event of non-cooperation by any party, the learned Magistrate shall be at liberty to proceed ex parte in accordance with law.

6. If the learned Magistrate finds the allegations of the petitioner to be true, the bail bond of the O.P. No. 2 shall be cancelled forthwith.
