The petitioner seeks regular bail in Kesariya P.S. Case No. 146 of 2014, registered for the offences punishable under Section 379 of the Indian Penal Code.

Petitioner is not named in the First Information Report. During the course of investigation, the petitioner is alleged to have confessed his guilt and on the basis of such disclosure made the stolen motorcycle was recovered from the house of the petitioner. The petitioner has already remained in jail for six and half months for theft of a motorcycle and only one criminal case under Section 379 of the Indian Penal Code is pending against the petitioner.

Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.2148 of 2015 (2) dt.19-01-2015 bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Motihari at East Champaran in connection with Kesariya P.S. Case No. 146 of 2014.
