JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 02-08-2018 The present writ petition has been filed for a direction to the respondent authority to issue PDS dealership licence to the petitioner in place of his father who died holding PDS licence bearing no. 2/86 in Bettiah District; and for connected reliefs.

2. Learned counsel for the petitioner submits that the father of the petitioner was a holder of the PDS licence which was renewed continually until his death on 15.09.2010. It is submitted that the petitioner approached the licensing authority on numerous occasions for issuance of PDS licence but to no avail.

3. None appears on behalf of the respondents despite repeated calls. However, it transpires from paragraph 6 of the counter

Patna High Court CWJC No.1961 of 2015 dt.02-08-2018 2/2 affidavit on record that even though the petitioner's father died on 15.09.2010, the petitioner never made any claim before the authority concerned for grant of PDS licence in his name nor has made any representation regarding grant of PDS licence in his favour.

4. Having regard to the stand of the respondents in the counter affidavit which remains uncontroverted and no rejoinder thereto has been filed on behalf of the petitioner, this Court finds the writ petition to be devoid of merit and the same stands dismissed.
