JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-03-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within four weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 325, 379, 504, 506, 307 of the Indian Penal Code.
Prosecution case in brief is that the informant alleging therein that on 21.08.2019 when he was sleeping near his Boring Pump then due to previous dispute, the petitioner came with other co-accused persons, who happened to be family members of the petitioner and they further assaulted to the informant by lathi and sharp cutting weapons and they also snatched the mobile phone and gold locket of the informant. Learned counsel for the petitioner submits that the

The injury reports are among the five injuries, 03 injuries are simple in nature and amongst the 02 injuries one at the left leg below knee and other at the left side of the chest are found to be grievous in nature. He further submits that Section 307 I.P.C. has been added in this case after about 09 months of the alleged occurrence. There is general and omnibus allegation against the petitioner and there is no overt act against the petitioner. The petitioner is languishing in judicial custody since 20.05.2020. The petitioner has got no criminal antecedent which is mentioned in para 3 of the bail petition.
Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Bihta P.S. Case No. 809/2019 to the satisfaction of the learned A.C.J.M.-Ist, Danapur, Patna.
