The petitioner apprehends his arrest in connection with Chakmehsi P.S. Case No.103 of 2021, registered for the offences punishable under Sections 376, 323, 504, 506 and 34 of the Indian Penal Code.

The petitioner is said to have committed rape with the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is also submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that medical report does not support the prosecution case.

Patna High Court CR. MISC. No.57092 of 2021(3) dt.13-10-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that there is specific allegation of rape against the petitioner. Taking into consideration the statement of the victim recorded under Section 164 Cr.P.C., I am not inclined to enlarge the petitioner on anticipatory bail.
