In this case, the petitioner is apprehending his arrest in connection with Supaul P.S. Case No. 501 of 2016 registered for offences under sections 409, 420, 120B of the Indian Penal Code.
An allegation has been made that one Moni Kumari, daughter of Yogendra Chaudhary was appointed as a Panchayat Teacher but, later on, it was found that she was below 18 years of age. On that account, the criminal case has been lodged. Learned counsel for the petitioner has submitted that one month before the meeting of appointment, the petitioner was
Patna High Court Cr.Misc. No.40667 of 2017 (2) dt.19-09-2017 transferred from S.D.P. High School, Hardi, Supaul to Manohar Durga High School, Singheshwar, Madhepura which itself indicates that he had not participated in the meeting of appointment.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Ramesh Prasad Yadav, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 501 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
