JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Petitioner is languishing in custody since 01.11.2014 in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B of the I.P.C and Sections 13(2) read with Sections 13(1)(c)(d) of Prevention of Corruption Act.
It is alleged that the term loan of rupees 1.6 crores were sanctioned in favour of M/s Vaishali Trading Private Limited. For the said loan amount the draft was issued by Punjab National Bank in favour of Standard Engineering Works for supply of machinery to the M/S Vaishali Trading Private Limited but it was found that on the basis of forged documents the loan were being sanctioned in favour of M/S Vaishali Trading Private Limited whose one of the Directors was Arvind Kumar Choudhary. It is alleged against this petitioner that term loan amount was siphoned through the fictitious account of Standard Engineering Works to the original loanee

It is submitted by learned counsel for the petitioner that admittedly the loan was sanctioned in favour of M/S Vaishali Trading Private Limited. The petitioner never submitted any document to the bank for sanction of loan. The bank Manager who sanctioned the loan has been granted bail vide Cr. Misc. No. 34399 of 2014.
It is submitted by learned counsel for the C.B.I that petitioner was a party to whole episode and has been charge-sheeted.
Considering the fact that loan was not sanctioned in favour of the petitioner and the fact that investigation has already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, C.B.I-I, Patna in connection with Special Case No. 09 of 2012, R.C No. 16(A) of 2012.
