JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2021 Heard Mr. Manish Dhari Singh, the learned Advocate for the petitioner and learned APP for the State. The petitioner, who is the father-in-law of the opposite party No. 2, seeks bail in anticipation of his arrest in connection with Sikrahata P.S. Case No. 156 of 2019, dated 09.12.2019, instituted for the offences under Sections 341, 323, 498-A, 504 and 506/34 of the Indian Penal Code
Patna High Court CR. MISC. No.768 of 2021(2) dt.24-06-2021 2/3 and Section 3/4 of the Dowry Prohibition Act. It has been submitted on behalf of the petitioner that no specific accusation has been made against him. It has further been submitted that on perusal of the F.I.R., it appears that there is general and omnibus allegation that the opposite party No. 2 was assaulted by the family members of the petitioner.
The husband of the opposite party No. 2 has been granted interim reprieve.
The learned counsel for the petitioner has further submitted that even the distant relatives of the husband of the opposite party No. 2 have been made accused in this case out of revenge.
Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 8th Additional Chief Judicial
Patna High Court CR. MISC. No.768 of 2021(2) dt.24-06-2021 3/3 Magistrate, Ara (Bhojpur), in connection with Sikrahata P.S. Case No. 156 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
