JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 04-12-2018 The present writ petition has been filed for quashing the order dated 06.12.2012 contained in memo no. 19050, passed by the Engineer-in-Chief, Rural Works Department, Bihar, Patna whereby he has declared the petitioner as defaulter and prohibited it from participating in future tenders; and for connected reliefs.

2. As none appeared on behalf of the petitioner the matter was passed over for a few cases. However, on repeat call the petitioner was again not represented.

3. Learned counsel for the respondents invites reference to para 5 of the counter affidavit, stating that the impugned order dated 06.12.2012 in so far it relates to the petitioner has already been withdrawn during the pendency of the writ petition vide

Patna High Court CWJC No.20742 of 2013 dt.04-12-2018 2/2 order contained in memo no. 11369 dated 04.10.2013 and as such the grievance of the petitioner already stands redressed.
