The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419/420/467/468/471/406/323/504/120B of the Indian Penal Code.
Perused the order dated 14.12.2018 wherein facts and merit of the case is well discussed. There is no material to substantiate that the petitioner was involved in the business of the company, which defalcated the invested amount of the informant; rather brother of the petitioner was involved in the business of the company.
Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.66454 of 2018(3) dt.21-01-2019 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Kazi Mohammadpur Police Station Case No. 401 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
