2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 342, 307, 504, 506 and 34 of the Indian Penal Code . 3 . Prosecution case , in brief, is that on the alleged date and time of occurrence , when the informant opposed the advertisement published by accused persons then all the F.I.R., named accused persons including these petitioners caught the informant levelling allegation of committing theft of gold chain and cash of Rs. 50,000/- and also assaulted and threatened to kill him.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.51879 of 2024(2) dt.21-08-2024 2/2 petitioners have committed no offence and have falsely been implicated in this case due to village politics and previous enmity . Allegation of assault is general and omnibus. Injury allegedly caused by these petitioners is simple in nature .
5. Learned counsel for the State oppose the bail petition.
6 Considering the nature of injury and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM Nawada in connection with Warsaliganj P.S. Case No. 518 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
