JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 21-08-2018 The present writ petition has been filed for setting aside the notice vide memo no. 47 dated 07.04.2015 issued by the Block Development Officer, Bhabhua by which the petitioner has been directed to deposit the price of 449.27 quintal of rice to the tune of Rs. 6,15,499/- in terms of the direction of this Court failing which the Block Development Officer will recommend for cancellation of PDS licence of the petitioner to the licensing authority.

2. At the very outset, learned counsel for the petitioner invites reference to paragraph 12 of the counter affidavit in which it

Patna High Court CWJC No.7536 of 2015 dt.21-08-2018 2/2 has been admitted that the outstanding amount of Rs. 6,15,499.90 paise against the price of 449 quintals 27 kg. of rice has already been deposited by the petitioner. Receipts showing payment of Rs. 6,15,499.90 paise have been enclosed with the counter affidavit.
