====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-07-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414, 413, 420, 120B of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act.

Petitioner and others were apprehended by the police on suspicion that they were preparing to commit dacoity. From possession of the petitioner, firearm and cartridges were recovered.

Submission is that petitioner is in custody since 01.11.2018. Investigation of the case is already closed. Coaccused Sonu Ansari has already been allowed bail by a Coordinate Bench of this Court vide order dated 29.01.2019 passed in Cr. Misc. No. 4577 of 2019 and allegation against the

Patna High Court CR. MISC. No.43998 of 2019(2) dt.18-07-2019 2/2 petitioner is similar to that of Sonu.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Basantpur Police Station Case No. 376 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
