The appellants are apprehending their arrest in connection with ABP No.595 of 2018 (arising out of Belhar P.S.Case no.299 of 2017) , registered for offences punishable under Sections 387, 504, 506/34 of the Indian Penal Code and Sections 3(1)(x) of SC/ST (Prevention of Atrocities) Act.

Allegation against the other accused persons is of abusing the informant by caste name and also against all the accused persons of thrashing the door and abusing by caste name.

Submission of the learned counsel for the appellants is that during the course of investigation several witnesses have stated that the appellants have not abused by caste name rather the allegations are against the other accused persons and the appellants have been only present there. Heard learned A.P.P. also.

APP (SJ) No.3994 of 2018 dt.21-02-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above let the appellants , above named, in the event of arrest or surrender before the learned Special Judge within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-1, Banka in connection with Belhar P.S.Case no.299 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
