The petitioner namely, Tunnu Paswan who is in custody in Konch P.S. Case No.10 of 2007 corresponding to G.R. No.115 of 2007 under Section 395 I.P.C.

It appears that F.I.R. was lodged by the informant against unknown about the commission of dacoity by unknown criminals.

The learned counsel for the petitioner submitted that one co-accused, Lalu Dass was arrested by police and in his confessional statement, he named the present petitioner. The said co-accused, Lalu Dass has already been granted bail by this Court in Cr. Misc. No.20975 of 2009. Except this, there is no evidence

Patna High Court Cr.Misc. No.48185 of 2014 (3) dt.10-04-2015 against the petitioner. Nothing has been recovered from the petitioner nor even the petitioner is put on Test Identification Parade.

Perused the record. It appears that the other coaccused persons namely, Vinay Das and Amar Paswan have also been granted bail and the co-accused named the petitioner has also been granted bail.

Considering the above facts and circumstances of the case that the petitioner's case is on same footing, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.10,000(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the court of Kumari Vijaya, Judicial Magistrate 1st class, Gaya in connection with Konch P.S. Case No. 10 of 2007(G.R. No.115 of 2007).
