Learned counsel for the petitioner is directed to remove the defect(s) within four weeks.
The petitioner apprehends his arrest in a case registered for the offence punishable under sections 493, 376, 506, 313, and 34 of the Indian Penal Code, 1860.
Allegedly, the petitioner is said to have cohabited with the informant for about two and half years on the pretext to solemnize marriage and lastly refused to do so. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation
Patna High Court CR. MISC. No.46685 of 2022(2) dt.05-12-2022 2/2 leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent. Per contra, learned APP for the State vehemently opposing the prayer for anticipatory bail has submitted that considering the seriousness of the allegation levelled against the petitioner, the petitioner does not deserve anticipatory bail. Having regard to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. The prayer for grant of anticipatory bail of the petitioner is rejected. The instant application is dismissed.
