The petitioner is languishing in custody in a case registered for the offences punishable under Sections 384, 386 of the Indian Penal Code.

It is a case of demanding extortion money on phone from the informant by one Imamuddin @ Mamu. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner has not demanded any extortion amount to the informant and he has been roped in the present case since the caller took

Patna High Court CR. MISC. No.48016 of 2023(3) dt.23-08-2023 2/2 the name of the petitioner and ordered the informant to give the extortion amount to the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The informant has not given any extortion amount to anyone. The petitioner is languishing in custody since 04.06.2023.

Learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 626 of 2023.
