JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-09-2021 Heard the learned counsel for the petitioner and Sri Shiv Mohan Saha, the learned counsel for the respondent- Bank. The present petition has been filed seeking following reliefs :- "(I) For writ in nature of certiorari for quashing of the possession notice issued by the respondent authorities dated 14.09.2021 and the same was pasted on the boundary wall of the house of the petitioner for an amount of Rs. 41,41,009/- as on 14.09.2021 with further interest, costs and other charges and expenses thereon.

Patna High Court CWJC No.16857 of 2021(2) dt.29-09-2021 2/3 (II) For directing and commanding the respondent authorities of the Bank not to take any coercive action against the petitioner as the petitioner is ready to repay the loan amount with the time prescribed at the time of grant of loan, in which 31 months still is left.

(III) For directing the respondent authorities Bank to allow the petitioner to repay their loan amount within the time as prescribed in the loan agreement.

(IV) For directing and commanding the respondent authorities to consider the matter sympathetically and wave the interest, as after investing huge amount in construction of godown and other expenses, the LPG license was not granted to the petitioner, for which the loan was taken as petitioner is poor, illiterate, lady and the small pieces of land are the source of livelihood for the petitioner. "

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no. 2 for redressal of her aforesaid grievances. The learned counsel for the respondent- Bank has got no objection.

Having regard to the facts and circumstances of the

Patna High Court CWJC No.16857 of 2021(2) dt.29-09-2021 3/3 case, the present writ petition stands disposed of as not pressed, however with liberty to the petitioner to approach the respondent no. 2 i.e. the Zonal Manager, Indian Bank, Muzaffarpur for redressal of her aforesaid grievances, which shall be considered sympathetically, in accordance with law.
