The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 342, 323, 452 of the Indian Penal Code and Sections 3⁄4 of Explosive Substance Act and Section 17 of C.L.A. Act.
It is a case of misuse of bail. The bail of the petitioner was cancelled in the year 2012. The petitioner, being a daily wage worker, had gone out of State for his livelihood. In his absence, proper pairvi could not be done and his bail was cancelled. When the petitioner came to know that his bail has been cancelled, the petitioner surrendered in the court below and he is in custody since 14.02.2019. The petitioner undertakes to co-operate during trial.

No.44804 of 2019(2) dt.23-07-2019 2/2 Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge IV, Gaya in connection with Dumariya P.S. case No.24/2009 (G.R. No.396/2009/ Sessions Trial No.149/18/448/11).
If the petitioner fails to appear in the court below on two consecutive dates, the court below will be at liberty to cancel the bail of the petitioner.
