JUSTICE ARVIND SRIVASTAVA ORAL ORDER 01-12-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Kodhobari P.S. Case No. 18 of 2017 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to admitted land dispute between parties. The injuries sustained have been found to be simple in nature. Moreover, the dispute has been amicably settled between the parties. Learned counsel has filed certified copy of the petition filed before the Court below to the effect that the matter has been compromised and
Patna High Court Cr.Misc. No.49176 of 2017(3) dt.01-12-2017 2/2 the parties do not want to proceed further in the matter. Let the same be kept on record.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, III, Kishanganj in connection with Kodhobari P.S. Case No. 18 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
