The petitioner is apprehending arrest in a complaint case wherein process has been issued after cognizance being taken for the offences punishable under Sections 498A/34 of the IPC. The prosecution case is that the complainant's marriage was performed with the petitioner on 12.6.2012 and for 4-5 years, the conjugal life was happy and the couple were blessed with one male and one female child. Thereafter, the petitioner developed intimacy with one Omi Kumbalkar. On protest being made by the complainant, Omi Kumbalkar, her mother with the help of others snatched the ornaments of the complainant and drove her out from the matrimonial house. The complainant was pregnant when the occurrence took place. Thereafter, the complainant gave birth to a female child, concerning which the

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant. It is further submitted that for the same occurrence, Akorhigola P.S. Case No. 15 of 2018 was lodged with accusation under Sections 341,323,498A and 504 of the IPC on 10.1.2018 in which the petitioner is on bail.

Considering the fact that in a case lodged earlier by the complainant with similar accusation the petitioner is on bail, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri in connection with Complaint Case No. 3 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
