The petitioner is apprehending his arrest in connection with Samastipur Complaint Case No. 750 of 2016 lodged under Sections 120, 120B, 161, 165A, 167, 203, 217, 218, 466, 467, 468 and 471 of the Indian Penal Code.
Allegation as per FIR is that two persons have been provided job on one certificate and allegation against the petitioner is that he has not enquired the matter and, as such, it was not detected earlier.
Submission of learned counsel for the petitioner is that petitioner being Block Education Officer was posted in the year
Patna High Court Cr.Misc. No.37188 of 2017 (2) dt.19-08-2017 2/2 2014, whereas appointments were made earlier in 80s. However, he has been falsely implicated in this case.
Heard learned APP also.
Having heard both sides and in view of facts and circumstances, let petitioner surrender before the court below within a period of four weeks and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Samastipur Complaint Case No. 750 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and he will co-operate in investigation, failing which his bail bond shall be liable to be cancelled.
