JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 The petitioner apprehends his arrest in connection with Special Case NO. 14 of 2014 arising out of Economic Offence Unit P.S.Case No. 04 of 2014 registered under Sections 109 and 120B of the Indian penal Code and 13(2), 13(1)(e) of the Prevention of Corruption Act.
Allegation as per FIR is that one co-accused was arrested in a disproportionate assets case and there is allegation against petitioner is of providing cheque to co-accused Kanhaiya Kumar in lieu of cash after manipulating evidence. It further transpires that petitioner is not named in the FIR but later on his name also transpired.
Patna High Court CR. MISC. No.67302 of 2018(3) dt.09-04-2019 2/2 Submission of learned counsel for the petitioner is that other co-accused persons, having similar allegation, have already been granted anticipatory bail by co-ordinate Benches of this Court vide order dated 26.06.2018 passed in Cr.Misc. No. 23724 of 2018 and order dated 20.09.2018 passed in Cr.Misc. No. 58061 of 2018.
Heard learned APP as well as learned senior counsel appearing on behalf of the Economic Offences Unit. They have also not controverted the above fact that other co-accused persons having similar allegations have been granted privilege of anticipatory bail by co-ordinate Benches of this Court, in such view of the matter, provisional anticipatory bail granted to the petitioner vide order dated 19.12.2018 is hereby confirmed with condition that he will co-operate in disposal of trial.
