JUSTICE AMARESH KUMAR LAL ORAL ORDER 13-04-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366A of the Indian Penal Code.

The allegation against the petitioner is to have kidnapped the daughter of the informant.

It is submitted that the informant has lodged this case in wrong impression. The daughter of the informant has made statement under Section 164 Cr.P.C. in which she has stated that no one has kidnapped her. While she was going to board the train at Sadra, the petitioner met him there and she returned to her house and her mother has lodged a case in wrong impression. The

Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in Falka P.S. Case No.218 of 2014 with the following conditions : 1.

One of the bailors will be the close relative of the petitioner.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
