The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 135 of the Electricity Act, 2003.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a meter reader and it is alleged that he gave a wrong bill to the consumer based on a wrong reading on account of which, the company suffered a loss.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. Human errors do occur while discharging duty. It cannot be said

Patna High Court CR. MISC. No.57075 of 2021(2) dt.05-07-2022 2/2 that petitioner for some ulterior reason had given a bill which caused revenue loss to the company. It is next submitted that petitioner by mistake gave wrong bill to the consumer and the Act was not deliberate.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner and in the nature of allegation, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Patliputra P. S. Case No.125 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
