This is a petition for grant of anticipatory bail in a case under Sections 406 and 420/34 of the Indian Penal Code. It is alleged that two Schemes, one for clearance of Nala bearing Yojna No. 01 of 2007-08 and another Yojna No.02 of 2007-08 for earth filling on the road and its soiling work have not been properly done. It is further alleged that the flank of Nala for filling sand has also not properly been constructed so that the road is not properly functioning.
It is submitted by learned counsel for the petitioner that in paragraph no. 49 of the case diary it has been mentioned that money was withdrawn prior to resignation of the petitioner from
Patna High Court Cr.Misc. No.43842 of 2014 (3) dt.15-04-2015 2 / 2 the post of Junior Engineer.
Hence, having regard to the facts and circumstances of the case, the petitioner above named, is ordered to be released on bail in the event of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., (West), Muzaffarpur, in connection with Kanti P.S. Case No. 277 of 2008, corresponding to G.R. No. 1850 of 2008, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
