21-09-2017 Heard Sri Sangeet Deokuliar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Kalyanpur P.S. Case No. 110 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Sections 30(a), (b), (c) and (d) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
By way of referring to page 10 of the petition i.e. copy of seizure list, learned counsel for the petitioner submits that the place, from where seizure was effected, was not in possession of the petitioner. By way of referring to paragraph - 7 of the petition, it has been argued that the place of seizure was neither plot of the petitioner, nor petitioner was having any
Patna High Court Cr.Misc. No.44551 of 2017(2) dt.21-09-2017 2/2 connection with the said room. In the case, there was recovery of about 19 liters of Indian make foreign liquor and petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition.
In view of facts & circumstances as well as clean antecedent of the petitioner, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Prince Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge cum Special Judge, Excise, Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 110 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C.
