2. This is the third attempt on behalf of the petitioner for grant of regular bail.

3. The learned counsel for the petitioner, while making prayer for bail, has submitted that, although firstly bail application of the petitioner was rejected by this Court, vide order dated 11.05.2023 in Cr. Misc. No. 39400 of 2022, but the petitioner is renewing his prayer for bail on the ground of his prolonged incarceration. He submitted further that the second bail application of the petitioner was also rejected by this Court, vide Cr.Misc.No. 2879 of 2024 under order dated 23.08.2024 wherein it was observed that the petitioner may renew his prayer

Patna High Court CR. MISC. No.46765 of 2025(2) dt.11-07-2025 2/2 for bail after nine months, if the trial is not concluded. It is also submitted by the learned counsel that till date the trial is still pending and the last witness was examined five months ago. The petitioner is in custody for near about three and half years.

Considering the facts and circumstances and also keeping in view the incarceration of the petitioner, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1, Banka in S.T.No. 165 of 2022, arising out of Banka (Barahat) P.S.Case No. 01 of 2022, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates, unless he is prevented by extremely adverse circumstances, the court below shall be at liberty to cancel his bail bond.
