The petitioner is in custody in connection with Special Case No. 2188 of 2019, arising out of Bihta P.S. Case No. 211 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case total 25 ltrs of foreign liquor was seized. Learned counsel for the petitioner would further submit that the mandatory provisions under Section 100 Cr.P.C. was not followed. The petitioner is in custody since 11.06.2019.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant him bail. Let the
