The petitioner seeks bail in Garkha P.S. Case No. 04/2014, registered for the offences punishable under Sections 413 & 414/34 of the Indian Penal Code.

The petitioner was arrested for theft of a trolly but from the house of the petitioner two motorcycles were recovered. The petitioner did not produce any documents of the motorcycles. Learned counsel for the petitioner submits that no recovery was made and petitioner has falsely been taken in the case. The petitioner is in jail since 19.09.2014 and he has no criminal antecedent.

There is no material on record to show that the petitioner is a habitual offender and keeping stolen articles.

No.48568 of 2014 (4) dt.16-04-2015 2/2 Considering the aforesaid facts that the petitioner have already remained in jail for about seven months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran in connection with Garkha P.S. Case No. 04/2014.
