The petitioner seeks bail in anticipation of his arrest in connection with Muzaffarpur Sadar P.S. Case No. 297 of 2020 dated 03.06.2020 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

The police party received information that huge amount of liquor is being transported and apart from the driver and owner of the vehicle, the petitioner is also sitting in the said vehicle. However, all the persons referred to above managed to flee away when the vehicle was intercepted. From the vehicle, 223.92 litres

Patna High Court CR. MISC. No.2831 of 2021(3) dt.27-07-2021 2/2 of liquor is said to have been recovered.

Regard being had to the aforestated facts, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, his application shall be considered on its own merits without being prejudiced by the fact that the present petition on his behalf has not been entertained.
