JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-04-2015 Heard both sides.

The petitioners, Vijay Kumar Singh and Suraj Kishor, seek bail in Pakridayal P.S. Case No. 59 of 2014 under

Patna High Court Cr.Misc. No.42540 of 2014 (3) dt.20-04-2015 2/3 Sections 366A/34 of the Indian Penal Code.

The allegation against the petitioners is that while they were fleeing after kidnapping the victim, both the petitioners and two other accused persons were apprehended by the police and the victim girl was recovered. Learned counsel for the petitioners submits that the petitioner in Cr. Misc. No. 4254/2014, namely, Vijay Kumar Singh is the driver of the vehicle bearing registration no. BR-31L-2258 and the petitioner in Cr. Misc. No. 8871/2015, namely, Suraj Kishor, is a resident of Punjab and he happens to be the friend of Ravi Kumar and, that is why, he came from Punjab. It has also come that Ravi Kumar had kidnapped the victim and took her to Punjab, from where the victim girl was recovered.

It appears that the petitioners along with two other accused persons are alleged to have kidnapped the victim and the petitioners and others were apprehended by the police and thereafter the victim girl was recovered. Having considered the facts aforesaid, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same within six months from the date of receipt of this order. If the trial is not concluded within the stipulated period

Patna High Court Cr.Misc. No.42540 of 2014 (3) dt.20-04-2015 3/3 of time, the petitioners may renew their prayer for bail firstly in the trial court.
