JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2022 Heard Ms. Patla Kumari, learned Advocate for the petitioners and Mr. Kalyan Shankar for the State. The petitioners seek bail in connection with Chausa P.S. Case No. 75 of 2022 dated 16.04.2022 instituted for the offences under Sections 379/411 of the Indian Penal Code.

It has been urged on behalf of the petitioners that they do not have any criminal antecedents and are in custody since 17.04.2022. In fact, the petitioners claim to have been arrested on mistaken identity. The petitioners were only visitors to the local fair when a suspicion was raised against them regarding theft of a motorcycle.

Nothing has been recovered from their

Patna High Court CR. MISC. No.47240 of 2022(2) dt.16-12-2022 2/2 possession.

Regard being had to the aforenoted facts, the petitioners are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate-I Class, Udakishunganj in connection with Chausa P.S. Case No. 75 of 2022.
