The petitioners apprehend their arrest in Makhdumpur P.S. Case No. 135 of 2017 instituted for the offence under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. It has been submitted that petitioner No. 7 namely, Chandeshwar Das @ Chaneshwar Das has already been arrested. Therefore, his prayer for anticipatory bail has become infructuous. Prayer for anticipatory bail of petitioner No. 7 is dismissed as having become infructuous.

So far as petitioner Nos. 1 to 6 are concerned, it has

Patna High Court Cr.Misc. No.40041 of 2017 (2) dt.31-08-2017 2/3 been submitted that there is general and omnibus allegation against them. The injuries found on the person of the injured are simple in nature. There is case and counter case between the parties.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner No. 1 to 6 namely, Ranjit Das @ Ranjeet Kr. Das, Ranjay Das, Niranjan Das @ Niranjan Kumar, Pramod Das @ Pramod Kumar Das, Dharmendra Das and Putun Das is allowed. In the event of surrender/arrest of the petitioner Nos. 1 to 6, named above, within six weeks from today, in connection with Makhdumpur P.S. Case No. 135 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
